Validity

The following general terms of business apply with regards to the business relationship between the Piranha Musik and the customer, likewise also for all future business. These conditions are based on the version in existence, at the time of the order. Deviant conditions set by the customer will not be recognized by the Piranha Musik, unless, Piranha Musik has agreed to these conditions in writing.

Offer

The offers presented on our internet pages are non-binding, and should be interpreted as an invitation to bid for the merchandise offered. An order becomes for us a binding agreement, as soon as we confirm it, or at latest when the goods have been posted. Piranha Musik is committed to accepting the order of a customer based on the terms indicated on the website. Piranha Musik reserves the right to withdraw claim, in cases of misprint or miscalculations on the website.

Delivery

The order will be posted as soon as possible. The risk is transfered onto the buyer as soon as the delivery has left the Piranha Musik premises. This is also the case when partial-delivery occurs. Specification over the time for delivery are non-comittal, as long as no delivery date had been assured. Regarding partial-delivery under reasonable circumstances, we remain justified. So long as the customer is contractually in arrears, we have no responsibility to deliver.

Property Rights

The delivered goods remain property of the Piranha Musik, until the buyer comprehensively fulfills all requirements which are to be met on his behalf.

Right of Withdrawal

The customer has the right to cancel the purchase. He may do so by sending a notice of withdrawal in writing and within 2 weeks after receiving the ordered goods (the date of the postage stamp has to be within this period). There is no need to state a reason for the withdrawal. If the value of the goods does not exceed 40 Euro, the customer has to bear the shipping charges, except the goods he received are different from the ones he ordered. In all other cases, we pay the expenses for a usual delivery.

Exchange

Exchange or refunding of CDs is not possible based on copyright law. For exceptions see under Liability and Refund.

Liability and Refund

In the event of wrong delivery, deviation in quantity, or manufacturing defects. Piranha Musik is not liable for damages which do not directly affect the delivered goods, in particular not for losses of profit or other such financial damages incurred by the customer. The customer, upon recieving damaged goods, has a 14 day period in which to submitt a written notification.

Applicable Law and Court of Jurisdiction

German law is applicable pending disqualification or exclusion of the UN - Rights of Purchase. The Court of Jurisdiction for all claims with regards to contractual business relations is Berlin (Germany)

The purchase price becomes due for payment when an order is placed (advance payment).

  Costs for this service (4,- Euro) will occur on top of postage. We charge you 2,- Euro beforehand and the postman will collect another 2,- Euro when delivering.

In case of default of payment, we are entitled to enforce interest at a value of 5% above that which the Bank may charge.

For your safety and security, we require that you enter your card's verification number. The verification number is a 3-digit number printed on the back of your card. It appears after and to the right of your card number.

For American Express card Holders

For your safety and security, we require that you enter your card's verification number. The American Express verification number is a small 4-digit number printed on the front of your card on the right hand side.
